Welcome to the fall edition of Anacomp Counselor, our newsletter dedicated to the legal community. I am pleased to report that despite the difficult economic climate, our company continues to make great strides.
We continue to land new, marquee accounts for CaseLogistix, our flagship litigation support platform. New customers include Latham & Watkins; McCarthy Tetrault; Bowman & Brook; Adduci, Mastriani & Schaumberg; Dechert; Munger Tolles and many others. In fact, we now count over two dozen AmLaw 200 law firms as customers, and this list seems to be growing by the day.
Our customers are also seeing great success leveraging the hosted version of CaseLogistix, enabling them to enjoy the full benefits of the solution without the upfront software license costs or the demands on their scarce IT resources to implement it. As such, hosted CaseLogistix is proving to be a quick, low-risk on-ramp to robust eDiscovery capabilities, and is easily expanded to larger and more complex cases as it delivers proven results.
We continue to make significant investments and upgrades to our CaseLogistix review platform, including its data ingestion (Waypoint) and production (CaseProduction) abilities. We’re also pleased to have expanded our litigation consulting abilities with the hire of Chuck Kellner.
Finally, our company recently announced it has obtained $7.5 million in new financing from Bridge Bank, National Association. The credit facility will help fund our efforts to accelerate our various strategic initiatives, which include expanding our presence in the eDiscovery market as a leading provider of litigation support consulting, services and solutions.

Charles Kellner is a litigation support veteran and a recognized expert in electronic discovery. He is a frequent contributor to continuing legal education (CLE), industry groups and legal publications. Mr. Kellner works onsite with corporate and outside counsel and IT personnel to preserve, collect, search, and produce electronic data used in litigation, mergers and acquisitions and government investigations. He assists in early case assessment, negotiating scope of discovery, searching and culling, and preparing for meet-and-confer. He has developed protocols for the exchange of electronic data in myriad proceedings, including those before the Justice Department, the FTC and the FDA. He has testified on issues of cost and burden, cost shifting, scope and sufficiency of discovery, and on computer forensic findings in fraud and trade secrets litigations.

Survey of Illinois Attorneys Points to Accelerating Adoption of CaseLogistix
On-Premise and Hosted Versions Gaining on 'Older Products' in the Marketplace
Anacomp recently cited results of a new eDiscovery survey of Illinois attorneys that point to accelerating adoption of its CaseLogistix litigation review platform. The results of the survey, published by the Law Bulletin Publishing Company, further indicate that CaseLogistix's growing market share is coming at the expense of what the report calls "older products" that have long been on the market, and that are experiencing either flat or declining use rates.
In the second annual survey, 372 lawyers responded to two dozen questions pertaining to several eDiscovery topics, experiences with vendors and solutions, and their most pressing challenges. Regarding their software of choice, CaseLogistix received a 10% use response rate, while the top two legacy vendors showed flat or declining use rate responses. All other software solutions received 7% or less use response rates. Anacomp's hosted review services based on CaseLogistix also made a leap in the survey rankings of Web-based eDiscovery applications, jumping from 5% to 13% use response and gaining on the leader, which dropped from 25% to 16%. Other web-based applications either held flat or dropped in the rankings.
"The litigation review market is going through a dramatic transition, with older, established vendors losing ground to exciting new players who are gaining in prominence," concluded Tom O'Connor, Director of the Legal Electronic Documents Institute, who helped conduct the survey. "The increased use of Web-based applications is clearly cutting into the market share of established but older products that may be falling behind in value."
"We're seeing a dramatic increase in interest and revenue for both the on-premise and hosted versions of CaseLogistix. Our market share and mind share are rapidly increasing within the legal community, and this survey provides another data point confirming this momentum," said Wayne Ford, Anacomp's Senior Vice President of Marketing, Channels and Strategic Alliances. "We believe the results of this survey are indicative of trends across the country, where CaseLogistix is making inroads against established legacy vendors."
The survey concludes that data collection and review expenses are the most important issues regarding eDiscovery in the minds of participants. The firm examined and certified controls in the areas of organization structure, governance and administration, physical and environmental, and system access, availability and performance.
Established by the American Institute of Certified Public Accountants, SAS 70 is a widely recognized auditing standard for service organizations to demonstrate they have adequate controls and processes in place. A SAS 70 examination demonstrates that an independent accounting and auditing firm has reviewed and examined an organization's control objectives and activities. At the conclusion of the examination, a formal report including the auditor's opinion is issued to the examined organization.

Dealing with Redaction in Document Productions

I am always keenly interested whenever a colleague in the industry shares a horror story related to a document production. Even the simplest mistake can sometimes get law firms in big trouble or bog down the case with hearings often needed to straighten out the mess. Many document production mistakes occur when producing privileged documents. Thank God for claw-back provisions, but sometimes the damage is already done.
The most common mistake I hear about these days is producing OCR or extracted text where the images were redacted, but the text files produced still had the un-redacted text. In a case involving trade secrets where sensitive data needs to be protected, the damage can be immeasurable. You can potentially lose a client for life. It’s simply not acceptable in today’s competitive legal market, especially in our uncertain economic times.
Fortunately, there is a tool to help you with document productions where it will not allow you to produce the text from redacted images. CaseProduction will create document productions in industry standard formats (Summation, Concordance, etc) with the OCR/extracted text files AND provide a separate list of the redacted OCR/extracted text files so you can re-OCR the files. I like the fact that it is dummy-proof because even the most attentive person can sometimes make a mistake when the clock is ticking and the production has to be out today.
